The Law

Understanding the Kenya Data Protection Act.

What It Is

The Data Protection Act, 2019 establishes Kenya's legal framework for the collection, processing and protection of personal data, enforced by the Office of the Data Protection Commissioner (ODPC). It closely mirrors GDPR's principles, but adds Kenya-specific registration and, in some cases, data-localization requirements.

Consequences of Non-Compliance

The ODPC can issue fines, and unregistered data controllers or processors face both financial penalty and operational risk — including enforcement notices that can halt processing activity.
